How
Can a Contested Conservatorship Litigation Attorney Help?
When a conservatorship is litigated, family members do
not always know what to do. For most

FIRST THINGS FIRST: CALENDAR THE DATE
AND JOT DOWN THE CASE NUMBER
If you have received a Conservatorship Petition and
a Notice of Hearing, you should immediately calendar the date of the
hearing in your calendar to insure you will be present,
or that your attorney will be there on your behalf. You
will want to immediately retain counsel to preserve the
deadlines for filing. When you object, you also want to
file a competing conservatorship petition, unless you believe that
the proposed conservatee has capacity, and wish to prove that.
WHAT ALTERNATIVES
HAVE BEEN EXPLORED BEFORE THE CONSERVATORSHIP?
The Court will want to know if the Conservatorship is the
least restrictive alternative. Look to see if the proposed
conservatee has capacity to execute a power of attorney.
Also look to see, if the conservatee will accept help and can be helped
with just reminders or easier ways to assist him/her.
TYPES
OF ACTIONS AND LITIGATION IN CONSERVATORSHIPS:
Contested Conservatorship and conservatorship
litigation actions can
involve any of the following situations:
1. Family members do not always beleive that a conservatorship is
needed.
2.
Sometimes, someone objections to a particular person acting, because
he/she may not be suitable. Objections to the initial appointment
of a
particular
person as a conservator can be filed to let the court know the nature
of unsuitability. A person with a conflict of interest is
usually not a good fit to become a conservator.
3.
Conservators who have engaged in wrongdoing or mismanagement of assets
of the conservatee, can be removed and replaced. A removal of an
existing Conservator must be for
cause.
4. Actions requesting appointment of a
successor conservator
to which others object are commonly litigated in court in Los Angeles.
5.
If a Conservator does not account, accounts late, or engages in
self-dealing or mismanagement, an objection to the accounting can be
filed. Disputes involving contested conservatorship accountings
are in the category of conservatorship litigation.
6.
Determination of a undue influence on an
elderly or
disabled person can be accomplished in a conservatorship case. Lets say that a person who lacks
capacity transfers a piece of property. To set that deed or
transfer aside, a conservatorship action can be filed, asking the
court to enable the conservator to file an action to recovery the
property.
7. A Conservator can create a will or trust with a special petition in
court with a court order. Objections to Proposed Actions by
Conservator including
substituted judgment actions and trusts can let the court know why the
will or trust should not be created.
8. Litigation over who is better as a conservator sometimes results in
family mediations in determining the best
conservator.
9. Many times, a Conservatee requests that the court end the
conservatorship. Requests to terminate a conservatorship or
modify powers
in a conservatorship are subject of litigation.
10. A Probate Code 850 action can be filed by a conservator, asking the
court to determine the rights to assets and
disputes relating to
ownership and title of property belonging to the conservatee.
11.
Conservatorship trials happen fairly fast and are very expensive.
