WHEN CAN A TEMPORARY CONSERVATORSHIP BE ESTABLISHED?

1.   A Temporary Conservatorship may be established when there is an urgency or emergency, which can be a medical emergency or when the assets of the affected person may be lost.  A Temporary Conservatorship is also referred to as an emergency conservatorship in Los Angeles.

2.   California Conservatorship law allows us to obtain a Temporary Conservatorship with an Ex Parte Hearing, which is usually with a shortened notice.   Sometimes, the Court will allow us to obtain them without notice when there are circumstances which justify it.

3.    When there is an imminent danger to the conservatee or to his /her assets, and a loss may occur fast, the Court will be inclined to allow us to protect the elder or disabled person in such unusual circumstances.

In an emergency, a Conservatorship can be created in five days or less to give you the ability to make legal decisions for another person.   A Conservator not only has a right to make decisions but the obligation to carry out those decisions faithfully towards the Conservatee.   Our Los Angeles Conservatorship lawyers can assist you with the conservatorship process in Los Angeles County.

Types of Emergency Conservatorships:

General Emergency Conservatorships in Los Angeles County can be three basic types:

1) Temporary Conservatorship of the person; 2) Temporary Conservatorship of the Estate; and 3) Temporary Conservatorship of person and estate.

There are a number of other types of Conservatorship matters also available such as LPS Conservatorships (mental health) and Developmentally Disabled (Limited) Conservatorships.

Setting up a Temporary Conservatorship is an active process where we must show the court our evidence of a true urgency or emergency.  Without an urgency, the Court will not grant an Ex Parte Temporary Conservatorship.

Who can file for a Temporary Conservatorship in Los Angeles?

Spouses, children, domestic partners, relatives, friends, the public guardian, and professional fiduciaries can ask the court to allow them to make decisions for the adult.     There is an order of priority prescribed by the Court.   A creditor cannot file for an emergency conservatorship or temporary conservatorship.

If there are a number of persons who have filed competing petitions for conservatorship requesting that each becomes the conservator, the court can decide who shall become the conservator based on the order stated in the statute, or in the person's estate planning documents, and if none, then based on his/her preference.   Preference laws exist for making such a determination. Contested Conservatorship proceedings can take a while, sometimes a year or longer, and may result in a trial.

A temporary conservatorship can be as short as five days or less, or over some months, or may become permanent, which can become a lifetime order.   There are many times when a conservatorship can be terminated by the request of the conservatee or, another adult.

A Conservatee is usually disabled or lacks capacity.  Conservatorships can be established on a voluntary basis if the adult consents to it.   Call us to discuss the temporary nature of the proceeding, or if you need a permanent conservatorship for a friend or relative.

WHAT IS THE NORMAL NOTICE PERIOD FOR AND EMERGENCY OR TEMPORARY CONSERVATORSHIPS IN LOS ANGELES?

The Court requires that unless there is a matter of life and death, that a five (5) day notice must be served on the family members and on the Conservatee.
